In the course of serving its customers and its project
participants, Active Agenda acquires, stores and transmits customer
and participant communications and information that customers and/or
participants may regard as private or sensitive. Some of this
information - such as name, address, telephone number, and email
address - is provided to Active Agenda by its customers and/or
project participants in order to establish community registration or
project participation. Other information - such as account status,
choice of services, and interface logs - is created and maintained by
Active Agenda in the normal course of providing service or support.
Active Agenda also uses cookies, which are small pieces of
information that a web site can store in a designated file on a
user's computer for various reasons. For example, Active Agenda uses
cookies on the landing pages of the Active Agenda Demo Login screen
which records the customer information that is required to
automatically login to the Demo on subsequent visits. However, this
information is not forwarded to any internal tracking database within
Active Agenda. In addition, Active Agenda may store customers'
electronic mail and other communications as a necessary to transmit
and delivery of services and communications.
Data Security
Active Agenda will protect the confidentiality of its customers'
and participants' information, account information and personal
communications in consistency with the law and the legitimate
interests of Active Agenda, its partners, its employees and other
customers of Active Agenda's services.
In an effort to keep customer data confidential, all Active Agenda
employees are required to sign an Employee Confidentiality Agreement
that includes the following statement to protect customer data:
Third Party Information. I recognize
that the Company has received and in the future will receive from
third parties their confidential or proprietary information subject
to a duty on the Company’s part to maintain the confidentiality of
such information and to use it only for certain limited purposes. I
agree to hold all such confidential or proprietary information in the
strictest confidence and not to disclose it to any person, firm or
corporation or to use it except as necessary in carrying out my work
for the Company consistent with the Company’s agreement with such
third party.
Active Agenda may from time-to-time contract with independent
contractors. All independent contractors with access to customer
and/or participant information are required to sign the same
confidentiality agreement, a copy of which is maintained on file by
Active Agenda, Inc.
How is customer and/or Participant information used?
Active Agenda may use customer and/or participant information to
provide its customers and/or participants with system information or
information about new or upgraded products. Active Agenda does
not rent, sell, or share customer or participant data or personal
information with any third parties.
Opt Out & Modifications
Customers may opt out of receiving notices of new or upgraded
products from Active Agenda and Active Agenda partners by sending an
Email to optout [at] Active Agenda.net, or by following the
unsubscribe instructions at the bottom of any Email notice that they
receive from Active Agenda. However, customers may not opt out of
receiving information from Active Agenda which is essential for
maintaining or updating customers' accounts or system information.
Most customers may access and modify their personal information
via their online personal control panel/account information page.
Disclosure of customer information and communications
Active Agenda will not otherwise disclose its customers' or
participants' personal and account information unless Active Agenda
has reason to believe that disclosing such information is necessary
to identify, make contact with, or bring legal action against someone
who may be causing harm or interfering with the rights or property of
Active Agenda, Active Agenda's customers, participants, or others, or
where Active Agenda has a good faith belief that the law requires
such disclosure.
Active Agenda also will not, except for reasons stated below,
disclose to third parties the contents of any electronic mail or
other electronic communications that Active Agenda stores or
transmits for its customers and/or participants. The circumstances
under which Active Agenda will disclose such electronic customer
communications are when:
it is necessary in order to
provide service to the customer or project participant;
it is necessary to protect the
legitimate interests of Active Agenda and its customers and/or
project participants;
it is required to cooperate with
interception orders, warrants, or other legal process that Active
Agenda determines in its sole discretion to be valid and
enforceable; and
it is necessary to provide to a law enforcement agency when
the contents are inadvertently obtained by Active Agenda and appear
to pertain to the commission of a crime.
Active Agenda disclaims any intention to censor, edit or engage in
ongoing review or surveillance of communications stored on or
transmitted through its facilities by customers, project
participants, or others. Active Agenda will, however, review, delete
or block access to communications that may harm Active Agenda, its
customers, its project participants, or third parties. The grounds on
which Active Agenda may take such action include, but are not limited
to, actual or potential violations of Active Agenda's Acceptable Use
Policy.
